Civil disputes

We can help you resolve disputes concerning the performance or breach of contracts, termination of a contract, compensation for damages, debt recovery and the payment of interest (fines, late payment penalties), or civil liability. We also represent clients in shareholder disputes, disputes relating to project design and contracting works, provision of IT and other services, disputes relating to intellectual property rights, and disputes relating to the infringement of a person’s honour and dignity.

Public procurement disputes

We provide assistance to both contracting authorities and suppliers in public procurement disputes. We represent suppliers in court disputes concerning public procurement, preparing claims against unlawful decisions taken by the contracting authority, applications for interim measures to suspend the procurement procedure or conclusion of a contract. We assist contracting authorities in dealing with suppliers’ claims, represent them in court cases with suppliers, and represent them during inspections and/or disputes with supervisory authorities.

Administrative disputes

We represent clients in disputes with public authorities and in administrative disputes (filing appeals against unjustified decisions, acts or omissions of the authorities, etc.), as well as in disputes with the authorities supervising activities or projects. Also we represented in disputes arising from public funding tenders and disputes relating to the administration of the state budget or EU funding. We represent clients in pre-trial proceedings, before the Administrative Disputes Commission and in administrative court.

Labour law disputes

We represent clients in employment-related disputes, both in pre-trial proceedings before the Labour Disputes Commission and in court. We prepare and submit necessary documents to the Labour Disputes Commission or the court. We provide consultations on issues related to the terms and conditions of termination of employment contract, suspension of the employee, non-competition and compensation of non-pecuniary damages.

Representing victims in criminal proceedings

We represent victims in pre-trial investigations, advise on civil claims, prepare necessary documents and represent them in court proceedings.

Family law and inheritance disputes

We represent clients in divorce cases concerning the division of property, in matters relating to the establishment and increase of child support (alimony). We also represent clients in solving inheritance disputes.

Protection of human rights

We understand human rights in a broad way. We provide consultations on issues related to protection of human rights – helping to identify whether an event can be classified as a human rights violation, preparing complaints to the Constitutional Court of the Republic of Lithuania or the European Court of Human Rights. We provide assistance in cases of violation of the right to a fair trial, the right to privacy, the right to an image, the protection of violated patients’ rights, and in other cases of human rights violations.

Successful
cases won

  • We have successfully represented the applicant Baltijos gėrimų pramonės aljansas in several administrative case concerning the implementation of EU funded programmes, in which the applicant was subject to disproportionate sanctionsincluding withholding of funds and administrative penalties. We obtained the annulment of the decisions of the supervising authority.
  • We represented a Viešųjų pirkimų agentūra in a complex dispute concerning application of contractual liability. We assisted a client in defending against an unjustified claim for performance of the service contract. In the case, we proved that contractual civil liability for breach of contract cannot arise.
  • We represented the Alytus District Municipality Administration in a dispute concerning the performance of contract works. We achieved that the Court of Appeal annulled the unfavourable decision and adopted a new one, satisfying our counterclaim for damages (default interest).
  • We represented Meno avilys before the Administrative Disputes Commission in relation to unjustified decisions taken by the Lithuanian Film Centre in connection with the assessment of the client’s application. We achieved a reassessment of the client’s application.
  • We represented the architects Siena (the Wall) in a dispute regarding building defects, where the designers’ liability was also at issue. We proved in court that the designers did not breach their contractual obligations.
  • We represented a sports poker player in a dispute regarding recovery of debt amounted to EUR 20,000 owed to him after he borrowed money to play online poker games. In the case, we were able to prove that the loan agreements were made using as evidence Skype and FB messages and transfers made through an online poker gaming platform.
  • We represent a client before the European Court of Human Rights for violation of the right to a fair trial. The case concerns the issue of unreimbursed full costs after winning litigation before a national court. The application has been accepted and a decision is pending.
  • We successfully represented our client in unfair dismissal case. The Court of Appeal upheld our position that reorganizations made by the employer (ministry) were fictitious and did not constitute grounds for dismissal, as well as that there were other procedural irregularities in the termination of the employment contract. The client was awarded with compensation and non-pecuniary damages. The Supreme Court of Lithuania upheld the decision in favour of the client.
  • We represented a client in a case in which the other party unjustifiably claimed reimbursement of the attorney’s costs incurred in the State Patent Office. The court upheld our arguments that the other party failed to prove the conditions of tort liability under the law, and the law does not provide for the institute of reimbursement of such costs at the pre-trial stage.
  • We successfully represented the client in a dispute before the Appeals Division of the State Patent Bureau regarding the similarity of trademarks. The Appeals Division upheld our arguments that there were no grounds for declaring confusing similarity to the trademarks “RAW”.
